1. Agreement to terms
These Terms of Service ("Terms") govern your access to and use of Brain (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. The service
Brain is a personal productivity application that provides tasks, notes, books, habits, a focus timer, and related features. We may add, change, or remove features over time. We strive to keep the Service available but do not guarantee uninterrupted or error-free operation.
3. Accounts
You must provide accurate information when registering and keep your credentials secure. You are responsible for all activity under your account. You must be at least 16 years old, or the age of digital consent in your country, to use the Service. Notify us promptly of any unauthorized use.
4. Subscriptions, billing and payments
Brain offers a free plan and paid plans: Pro (a recurring subscription) and Lifetime (a one-time purchase). Payments are processed by Stripe; by purchasing, you also agree to Stripe's terms. Paid plans are billed in advance. Pro subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from the billing portal; access continues until the end of the current paid period. Prices may change with notice for future billing periods. Taxes may apply depending on your location.
5. Free and Pro features
Some features and modules are available only on paid plans. We may change which features are included in each plan. If you downgrade or your subscription lapses, access to Pro-only features and the data within them may be restricted until you upgrade again, though we retain that data as described in our Privacy Policy.
6. Acceptable use
You agree not to misuse the Service, including by attempting to breach security, disrupt the Service, access other users' data, reverse engineer the software, or use it for unlawful purposes. We may suspend or terminate accounts that violate these Terms.
7. Your content
You retain ownership of the content you create in Brain. You grant us a limited license to store and process your content solely to operate and provide the Service to you. You are responsible for your content and for keeping your own backups of anything important.
8. Intellectual property
The Service, including its software, design, and trademarks, is owned by us and protected by law. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Upon termination, your right to use the Service ends; provisions that by their nature should survive will survive.
10. Disclaimers and limitation of liability
The Service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. We are not liable for any indirect, incidental, or consequential damages, or for loss of data or profits, arising from your use of the Service. Our total liability is limited to the amount you paid us in the twelve months before the claim.
11. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of [your jurisdiction], without regard to conflict-of-law rules. Any disputes will be subject to the courts located in [your jurisdiction], unless mandatory consumer-protection laws in your country provide otherwise.
